There’s a story that maybe apocryphal that a law summit including CCP members discussed the privacy of the “rule of law”. The Westerners spoke of legal ideals equity, standing, procedure yadda, yadda, yadda. The CCP members chortled since they KNEW that law was the tool of the PARTY. Guess they were right all along. I don’t know about Maluach’s situation in particular, but there’s 2 issues going on with South Sudanese people in the US. (and my interpretation of immigration law is from 25 years ago when I worked for an immigration law firm)

There’s the refugee group who currently have Temporary Protected Status, which allows them to legally live and work in the US and travel if they get additional approvals. This status is approved until November, but if it expires and isn’t extended by the administration or if they end it early, these refugees will have to leave the US.

Then there’s visa holders who entered the US for school or work or tourism. They got their visas cancelled, but visas are issued by the State Department specifically for entering the US. The work or school authorizations are separate documents issued by DHS. So even if they get the visa cancelled, they can stay in the US doing what they’re allowed to do, but if they leave the US, they can’t come back without a new visa.

I don’t know which group Maluach falls in, but he should be OK either way for now. And then once he’s drafted, his NBA team can apply for an O visa for him. The Toronto Raptors might have other considerations as well, so he could be off their draft board altogether.

Yeah, I’m not going there. I try to avoid political commentary on here and I probably failed at that some today. But I’m going to keep trying to avoid it as best I can.

Being a college hoops fan now requires a working knowledge of antitrust law, practice, and jurisprudence. I really hope it doesn’t come to require a working knowledge of immigration law or I’m up Schitts Creek!

The NCAA draws plenty of lines. They just cave when someone steps over it.

NCAA clearinghouse such a joke. 100 bucks to be in there for US kids and 160 for foreigners. Free money to the clearinghouse

Zugic for Creighton wound up missing 1/3 or so of the season. Not sure if that was a penalty or whatever or if just took that long for the NCAA to come to a decision.

Plus that was a whole year ago, which in the way college sports is moving and changing, might as well have been 1979.

Yeah, Zugic is definitely a cautionary case. I think he initially got denied but then got eligibility on appeal, so maybe the appeal is what pushed it into the season. And then he got ruled as having only 1 year of eligibility. The new challenge: How to determine how much college eligibility these players have. The current guide is that a player’s year in school is determined by his graduation date. Once a prospect overseas graduates high school, he has a gap year and then he must start studying as his eligibility clock begins. Creighton’s Fedor Zugic, for instance, joined the Jays last year as a 21-year-old and was ruled a college senior because he had more than one gap year due to some commitments with his national team; he has filed for another year of eligibility.
