I truly don’t understand the theory of the case from the player’s side here, perhaps because I am not a lawyer. Division II doesn’t prohibit NIL, right, it just doesn’t routinely offer it because the money isn’t there? He wasn’t really barred from any earning opportunities.

You’d probably have to grab the opinion in the Nyzier Fourqurean case the complaint references. Similar circumstances (at least per Brzovic), but the judge ruled narrowly rather than broadly. :man_shrugging:

Looking at it now: ORDER Granting Preliminary Injunction. Signed by District Judge William M. Conley on 2/6/2025. (Watson, Nathan)

The facts seem different:

  • Fourqurean’s father passed away right before the season in D2 that the complaint wanted to not count
  • He played pretty sparingly in that season (155 snaps spread across 11 games) and they presented testimony from his D2 coach that he wasn’t ready to play given what had happened in the offseason

And the judge was pretty narrow:

  • He seemed warm to the idea that some limit on eligibility keeps a connection with academic progress
  • He very much did not like the idea of not starting an athlete’s eligibility clock until they got to D1 and amusingly walked through a hypothetical where someone could stay in college for 11(!) years if this were the case.

Not sure how much of what drove the injunction will apply to Brzovic. But this is a layperson’s reading.

Its all about expectations. Compared to end of last week, things look great!

I had an interview at Darden my 2nd year with a bank (don’t remember who anymore) in the fall of '97 and the market had spent the whole week falling apart. The interview was going fine, but my interviewer was obviously distracted and unhappy.

After about 10 minutes, he sighed deeply and said “Look, I’ll be honest. A deal I’ve spent the last 4 months working on is in the process of falling apart while the market tanks. If you let me spend the rest of our hour making phone calls to try and salvage things, I would really, really appreciate it. I’ll just say random nice things about you.”

I told him it was cool, my focus was really on consulting anyway (which was true), and wished him luck. I wish I remembered his name, because I always wondered if he managed to save his deal.
