💰 Name-Image-Likeness (NIL) Discussion

Make them 1099 contractors? Courts have shown themselves repeatedly to be very employer / corporation friendly with how those are wielded.

Yeah, assume collectively bargained contracts are a no-go for the next few years or so. At least as we currently understand collective bargaining. There’s some talk of creating a different framework in the various legislation being discussed

7-8 mil plus revenue sharing:

Sources indicate Odom will have between $7-8 million to operate with when he takes over, nearly four times what was available to the previous staff. That doesn’t include the revenue sharing directly from the university, which kicks in July 1.

Before then, Walker said players will be signing front-loaded deals, getting their payments before the House settlement, which includes caps on what programs can pay athletes.

Have we seen any estimates of our revenue sharing $ and allocation across sports?

And I wonder if that $7-8 mm goes away next year. You’re supposed to still be able to get NIL deals on top of revenue sharing just not through collectives right?

This is gonna be weird. With that in place we should definitely pay iMac, and we should get some really good guys with a lot of years left.

It’s going to be very weird. This is probably the peak NIL spend year for everybody if I’m thinking about it correctly.

I don’t think so, Teel reported specifically that UVA won’t be writing in specific revenue share percentages into Odom’s contract (UNC did that with Belichick with football). He did note the general expectation for power conference programs: Ryan Odom part of UVA’s ‘culture shift’ into the NIL world

Most power conference schools are expected to reserve 60-70% of revenue sharing for football, 15-20% for men’s basketball. That translates to $3-4 million in revenue sharing for men’s basketball, plus NIL contracts.

That’s similar to what I’ve seen publicly: Kirby Hocutt details Texas Tech plan for revenue-sharing era

That’s the question. Unclear to me how much of the existing collective-delivered NIL will actually just be folded into revenue sharing going forward vs. continue as 3rd party payments that need to make it through the clearinghouse. The clearinghouse will be a huge pivot point for what athlete compensation looks like; unclear how tight they will be.

Yes. Carter Myers and Jonathan Cotten (and Rhoback) can make their own deals with athletes for their name, image, and likeness.

$8 million is 4x what we had before… and I thought reports here were that we were previously very competitive in NIL (even upper echelon). Were reports wrong, and we were way behind, or did NIL just absolutely explode this year (across the sport, not just us)?

Unclear on the former, and absolutely on the latter.

Good read from Dellinger on this from back in January.

If the underlying story is that everyone’s NIL budget went up 4x, then it’s a lot less exciting to have $8 mill to throw around. No competitive advantage to that if we’re just keeping up with inflation.

I don’t know what the clearinghouse is. But I believe the vast majority of “revenue” for athletic departments comes from donations, and I believe that to be the case for collectives as well.

Here’s our breakdown (For some reason I couldn’t quickly find an actual recent AD annual report)

The good news is we have the revenue to be at the cap if we so choose.

The other possibly good news is that in theory we good be very competitive in basketball funding if we simply accept that we can’t compete in football funding.

The bad news is that other schools will find ways to work around the cap with sketchy NIL deals and we will continue to be all UVA about it.

Deloitte gets to look at any 3rd party NIL deal over $600 and “evaluate whether these deals are within a reasonable range of compensation and made with the purpose of using a student-athlete’s NIL to advance a valid business purpose”

I bet that gets challenged in courts and overturned so there won’t be a cap.

Nor should they imo. Totally understand coaches wanting it, but in an ideal scenario you move it around a bit year to year, moving money into basketball if we think we’re close to a special team or something. Theoretically could go the other way too but I doubt it lol

Also encourages a little thriftiness from the coaching staffs. Money you have to burn each year can be dangerous and should have consequences if spent poorly.

Clearinghouse: Essentially, any outside organization wishing to enter into NIL deals with athletes has to register with the clearinghouse and all deals are vetted to ensure fair market value and that boosters aren’t trying to use NIL deals as a way to evade collectives and therefore the salary caps, as they are, or will be.
