I think the antitrust counterfactuals are difficult. Because, just like tech, there is interest from both parties (I think) in not allowing the NCAA too much power. For example, if the NCAA had settled out of court, would Lina Khan or AAG Kanter have fired up their own investigation? Would the Republicans in the Senate who are part of rising educational polarization call for investigations?
I don’t think there is the political appetite in Congress currently to carve out NIL exemptions for the NCAA and I don’t think the neo-brandeisians charged with enforcing the competition laws would feel any differently.
I don’t think NCAA v. Board of Regents would be enough to overcome not allowing use of image and likeness especially with how big the industry is
Interestingly enough, AAG Kanter will be here for an event next week, maybe worth asking him what their thoughts are on the NCAA and its recent changes
Serious thought. It’s really hard to disentangle:
- NIL
- No sit-out transfer rule change
- Covid 5th year
- (maybe lesser) still some lingering poor development and not fully informed recruiting choices from lost AAU and HS seasons?
I think all those things are contributing and intertwining with each other, right now. The outcomes are now are a result of the combination of those things, not any one of them in isolation.
I think what would help a lot is not allowing first years access to the one time transfer rule.
I knew so many people who became homesick their first year of college regardless of where they were. Most of them stuck it out and did not regret doing so. But if they had had suitors like athletes do, they would have been gone.
Almost every 17/18 year old gets homesick/grass is always greener, but for most normal kids it is hard to transfer so you don’t do it. For someone like a kid from nebraska who moves halfway across the country and has constant suitors wanting to drop him a bag, it is a constant distraction and healthy for no party involved

Totally agree had that exact conversation with someone the other day. It was the perfect timing of all those things and I’ll toss in the player empowerment era that have made the melding pot we currently have and there’s no way out of it by addressing any one of those issues.

I mean the transfer portal is pure chaos, but there’s not 500-800 dudes in the portal who are going to be key contributors at an elite basketball school. Nijel Pack doesn’t get 400k/year as an undersized “combo” guard unless there aren’t many like him available.
5-star type transfer players will go to whoever can promise $$$, playing time, and national exposure similar to what high school 5 stars are looking for.
