I wasted a few minutes of my day reading that, and fwiw, I don’t think that’s a particularly compelling argument. The rules in Alston and O’Bannon were all about limiting $$ whereas this rule may have been motivated by resource equity among schools (according to some googling Crane did before he wrote it). But it probably was motivated by lots of other stuff, too…
Anyway, I have no doubt Michigan has a lot of $$ riding on this and will explore some options so they can get the CFP payout…
Also, I still tend to think that the NCAA backed themselves into a particularly bad concurrence with a particularly dumb stance in the Alston case and is now suffering for it. To which I say, boo-hoo, but I also say, we are not gonna like what Greg Sankey sets up anymore to replace the NCAA. Nobody likes the HR department…
I think the major difference is that the benefits rules impacted the students directly, students who had no say or vote in the matter. This regulation impacts the school/team, which did have a vote (and presumably voted for the rule). There is an indirect impact on the students, but it’s not the same level.
Anyway, I think I’ll keep laughing at Michigan and the whole situation, but none of this is raising my level of cares in any way.
Columnist Matt Levine has a bit about “is everything securities fraud?” And I feel like we are undergoing a variation of that asking “is everything an antitrust violation?” in college sports. But I’m not sure these schools are ready to take this to its logical conclusion. The original purpose of allowing reasonably wide latitude for rule setting was so that you could have a recognizable sport at all- what’s next, unlimited scholarships, unlimited players, some teams use two balls and others one?
A&M one of the few schools to have the money to carry multiple buyouts. Elko may feel more urgency to move after the season has trended down he’s not as hot as he was a month ago. That said I knoe Duke Alumni have gathered a small war chest if someone does come calling. But A&M plays a different game.
I’d also say the A&M job is trash the money is great but the donors are too hands on. Very similar to Auburn
That’s the kicker. It’s a perfect spot for a mercenary which is why Jimbo thrived. Not sure if it’s as good for a guy still building like Elko. But 12mil will change a lot of minds

The last guy TAMU hired had a national championship pedigree. No way they’re aiming as low as Elko, people just talk about him because he was an assistant there.
I’m thinking they’ll hire a much bigger name. I’m thinking Urban Meyer. Jim Harbaugh. Dabo Swinney.
