I mean the ncaa is not a government run org so technically they aren’t responsible to fill the same obligations. An ncaa sanction is just a ruling not a legal one.

If you’re an Athletic subscriber, good article about the Jaden Rashada situation that gives more of an inside look on the mechanics of NIL (in football, at least):

Is there any regulation on who can be a NIL advisor on the recruit side? Seeing that one of his NIL advisors ended up being a SMU sophomore set off warning bells in my head.

My quick understanding is no. Because of the vagueness surrounding the word “advisor”

That sounds right, and also a recipe for bad stuff happening. I thought about it because I think his representation should have been reticent to stick him with a contract that can be unconditionally terminated by the collective.

Agree another one of the issues with the whole situation, and I wouldn’t be surprised if it plays into the downfall/restructuring of NIL at some point.

I look at the current NIL market similar to how I view crypto (feel free to chime in LRA financial experts because I’m riffing now). The thing that makes it great the unregulated wild west nature of the NIL market is also what will be it’s downfall. the lack of regulation/thought out guardrails creates a lot of cracks for things to slip through that will eventually lead to the attention and overcorrection of a governmental agency.

We’ve had this conversation before, but what does it all reasonably (ie not going back to just scholarship + cost of attendance. Even if some here would like that it’s not happening) look like it 10 years?

I imagine there will be some sort of collective bargaining agreement(s) at some point but curious as to whether it ends up being by sport or conference? Do football and basketball go together? Do the mid level sports like baseball, softball, and hockey team up?

I’m awful at predictions. Now forget that caveat and here are some predictions:

  • Conferences get more power. There’s already some groundwork here. The “autonomy conferences” concept. Sankey pushing for tourney changes.
  • There’s some legislative change around limited antitrust immunity for the NCAA and more importantly, conferences, to set certain NIL limits. (decent somewhat mildly comparable precedent in what schools can do in financial aid cooperation).
  • Those NIL cooperatives get less wild westy and move closer to something just like the standard salary payer, but we never quite get to schools just outright paying kids or any sort of collective bargaining (i.e., unionization) because …
  • Barring unforeseen changes in our politics, I think limited antitrust immunity can get bipartisan support and I don’t think a change to student athlete status can.

I think @haney is on the right track with his predictions. I see some sort of Super conference conglomerate overtaking the NCAA as the primary venue for top tier sports. Certainly when it comes to football but I can see them shoehorning in basketball too. Through the new league/set up along with help from some Congressional legislation we see some sort of a cap/structure for NIL come into existence.

I routinely come back to a short list of driving factors that I believe will determine the future of NIL

  • The elite (read the schools and conferences) don’t want to see all this money going directly to players without them getting their share, that’s too much transformational power going into the hands of the many and life doesn’t work that way.

  • Because of or in addition to the above, we will see Title IX play a role in the changing of the rules as it will be leveraged as a way to express the need for equality

  • NIL on the whole is cleaned up as the small hyperlocal donors begin to dry up. Back to the first point, eventually schools, conferences and the elites are going to get sick of Jimmy’s Used Car sales of Norman Ok. being the biggest driver of a teams success because they are dropping bags, and they will find a way to regain that power.

Does anyone on this forum have a rough idea of the type of NIL money a top UVA basketball player is making this year? Are we talking 5-digits or 6-digits? I’m just curious.

Those numbers jive with what I have. The majority are south of that high 5 to 6 figure number.
